Kacy Hagerty: All right, most of us remember the miracle weight loss drug Fen-Phen and all of the lawsuits that happen there, but just remind everybody what happen with this. Jim Higgins: Right. See, I thought you’re too young to remember. Kacy Hagerty: I’ve heard about it. Jim Higgins: But - right, Fen-Phen for those of us that are old enough was this miracle drug. It’s what everybody thought it was and it was a diet drug and people took it all over this country, millions, and lost weight very easily. And, then, after it had been on the market for a while, it was discovered that the drug can cause severe heart damage. Kacy Hagerty: Yes. Jim Higgins: And, once - all of that went through litigation, we have lots in our office back then. There was a settlement to get people enough money to help cover for the lost wages, medical bills, all of those things that we look for, and all of these drug cases that we talk about when there’s been a big recall. Kacy Hagerty: Oh, yes. Jim Higgins: But - so, yes, that was 10 years ago and what’s interesting is unlike some of the devices we’ve handled, there’s been a little bit of a resurgence in these cases and we are seeing them kind of creep or pop back up a little bit. Kacy Hagerty: OK and so kind of what’s the delay in seeing the health problems that were affected by Fen-Phen, the miracle weight loss drug? So, what happens now if someone just now experiencing those problems? Jim Higgins: Yes. Kacy Hagerty: Can they do anything about it? Jim Higgins: Yes and that’s what’s interest - I guess, interesting from it and why it’s so strange is - what we’ve discovered and there’s been some additional litigation on it is that a lot of health problems just like you said there was a big delay. The big one that’s coming up now is what we call primary pulmonary hypertension. It’s a blood problem that has been proven to be related to Fen-Phen which can also create damage not only to your lungs, but to your heart. So, people that took this drug maybe in the late ’90s that have been diagnosed with PPH recently or having severe heart problems that they’re having to have surgeries on, they have an opportunity to have a claim against this settlement against Fen-Phen to hopefully recover some of these medical bills, loss wages, pain and suffering, those things. Kacy Hagerty: Right. Jim Higgins: So, yes, we’re seeing a little bit of resurgence in these claims. Kacy Hagerty: Right. Jim Higgins: We’re seeing these in our office now. Kacy Hagerty: And, if someone has taken a drug that has been recalled, when should they contact you? When should an attorney get involved? Jim Higgins: Well, I think they should call our office immediately. You know, first you call your doctor... Kacy Hagerty: Yes. Jim Higgins: ...if your - if it’s the drug that you’re, don’t ever just stop taking it. Discuss it with your doctor. But, you know, the one thing that’s changed over the years is that the internet is such a great equalizer for us all. So, the people that may have had problems and never known that it was related to a drug, well, now with a simple search, you’re finding out if there’s been a recall. So, yes, if you’ve taken a drug, if you have a health problem that’s related to that drug or if that’s a hip recall or Fen-Phen or (Baicall) or whatever it may be, then call our office and we can discuss what your options are.
